ஜெயலலிதா ஆட்சியின்போது நடந்த சுடுகாட்டு கூரை ஊழலை அம்பலப்படுத்தியவரும், தற்போதைய திமுக அரசு கொண்டு வந்து தற்போது முடமாகிக் கிடக்கும் அரசு கேபிள் டிவி நிறுவனத்தை, சன் டிவியின் சுமங்கலி கேபிள் விஷன் நிறுவனத்திடமிருந்து காக்கப் போராடி தற்போது ஊழல் குற்றச்சாட்டை சுமந்து நிற்பவருமான ஐஏஎஸ் அதிகாரி உமாசங்கர், தன்னை அரசு பழிவாங்குவதாக கூறி சென்னை உயர்நீதிமன்றத்தில் வழக்கு தொடர்ந்துள்ளார்.

மேலும் அமைச்சர் ஒருவர் மீது குண்டர் தடுப்புச் சட்டம் மற்றும் தேசிய பாதுகாப்பு ச் சட்டத்தின் கீழ் நடவடிக்கை எடுக்கப் பரிந்துரைத்ததால் ஆத்திரமடைந்துள்ள அரசு தன்னைப் பழிவாங்கும் வகையில் ஊழல் வழக்கை ஏவி விட்டுள்ளதாகவும் அவர் குற்றம் சாட்டியுள்ளார்.

தமிழ்நாடு பிரிவு ஐ.ஏ.எஸ். அதிகாரியாக 1991-ம் ஆண்டு பதவியேற்றேன்.

1995-ல் மதுரை மாவட்ட கூடுதல் கலெக்டராகவும், மாவட்ட ஊரக வளர்ச்சி முகமை திட்ட அலுவலராகவும் பணியாற்றினேன். அப்போது ஜவஹர்லால்நேரு வேலைவாய்ப்பு திட்டத்தின் கீழ் சுடுகாட்டு கூரை கட்டுவதற்கு ஒப்பந்தம் வழங்குவது தொடர்பாக மாவட்ட கலெக்டரின் தவறான உத்தரவை செயல்படுத்த மறுத்துவிட்டேன்.

1996-ம் ஆண்டு விஜிலென்ஸ் இணை கமிஷனராக நியமிக்கப்பட்ட நேரத்தில் முன்னாள் முதல்வர், அமைச்சர்கள், மூத்த ஐ.ஏ.எஸ்.அதிகாரிகள், அதிகாரிகள் மீது ஊழல் வழக்கு தொடர்வதற்கு பரிந்துரை செய்தேன்.

1999-ம் ஆண்டு முதல் 2001-ம் ஆண்டு வரை திருவாரூர் மாவட்ட கலெக்டராக பணியாற்றினேன். 2006-ல் எல்காட் நிறுவனத்தின் நிர்வாக இயக்குனராகவும், பிறகு 2008-ம் ஆண்டு அரசு கேபிள் டி.வி.கார்ப்பரேஷன் நிர்வாக இயக்குனராகவும் நியமிக்கப்பட்டேன்.

பதவி ஏற்றது முதல் எந்தவித புகாருக்கும் ஆளாகாமல் நேர்மையாகப் பணியாற்றி வருகிறேன். அரசு கேபிள் டி.வி. நிறுவனத்தின் நிர்வாக இயக்குநராக 2008, அக்டோபர் 30-ம் தேதி நியமிக்கப்பட்டேன். சன் டி.வி. குழுமத்துக்குச் சொந்தமான சுமங்கலி கேபிள் டி.வி. நிறுவனம் அரசு கேபிள் டி.வி. நிறுவனத்தை முடக்க அனைத்து விதமான முயற்சிகளையும் மேற்கொண்டது.

எஸ்.சி.வியின் சட்டவிரோத நடவடிக்கைகள்

இந்த முயற்சிகளில் இருந்து அரசு கேபிள் டி.வி. நிறுவனத்தைப் பாதுகாக்க முயற்சிகள் மேற்கொண்டேன். சுமங்கலி கேபிள் நிறுவனத்தின் சட்ட விரோத நடவடிக்கைகளையும் அரசின் கவனத்துக்குக் கொண்டு வந்தேன்.

சுமங்கலி கேபிள் நிறுவனத்தை தேசியமயமாக்குவதுடன், அமைச்சர் ஒருவர் மீது தேசிய பாதுகாப்பு சட்டம், குண்டர் தடுப்புச் சட்டம் ஆகிய சட்டங்களின் கீழ் நடவடிக்கை எடுக்கவும் பரிந்துரைத்தேன்.

இதையடுத்து, சிறுசேமிப்புகள் துறை ஆணையராக நான் பணியிடமாற்றம் செய்யப்பட்டேன். இப்போது அரசு கேபிள் டி.வி. நிறுவனம் செயலிழந்து காணப்படுகிறது.

சுமங்கலி கேபிள் நிறுவனத்தை தேசியமயமாக்க வேண்டும் என்ற பரிந்துரைத்த காரணத்தால், என் மீது துறை ரீதியான ஒழுங்கு நடவடிக்கை தொடங்கப்பட்டது. சட்ட விரோதமான இந்த ஒழுங்கு நடவடிக்கைக்கு மத்திய நிர்வாக தீர்ப்பாயம் தடை விதித்தது.

இதைத் தொடர்ந்து, வருமானத்துக்கு அதிகமாகச் சொத்து சேர்த்ததாகக் கூறி ஊழல் தடுப்பு போலீஸ் அதிகாரி ஒருவர் என்னிடம் விசாரணை நடத்தினார். ஆனால், என் மீது எந்த வழக்கும் பதிவு செய்யவில்லை.

ஐ.ஏ.எஸ். அதிகாரி என்பதால் அவ்வப்போது எனது சொத்து விவரங்களை அரசிடம் சமர்ப்பித்து வருகிறேன். என் மீது விசாரணை நடத்துவதற்கு சட்டப்படி அனுமதியும் பெறப்படவில்லை.

ஊழல்வாதிகளைக் காப்பாற்றும் தமிழக அரசு

நேர்மையாகவும், பொதுமக்களுக்கு நன்மை தரும் வகையிலும் செயல்பட்டதால் என் மீது களங்கம் கற்பிக்கும் வகையில் இந்த விசாரணை மேற்கொள்ளப்படுகிறது. ஊழல்வாதிகளையும், அதிகாரம் மிக்கவர்களையும் காப்பாற்றும் அரசு, அமைச்சர் மீது நடவடிக்கை எடுக்கப் பரிந்துரைத்ததால் என்னை பழிவாங்குகிறது.

வருமானத்துக்கு அதிகமாகச் சொத்து சேர்த்ததாக போதுமான ஆதாரங்கள் இருந்தால் வழக்குப் பதிவு செய்து நடவடிக்கை எடுக்கலாம். ஆனால், விசாரணை என்ற பெயரில் என் மீதும், எனது குடும்பத்தினர், நண்பர்கள் மீது போலீஸாரை ஏவி விட முடியாது. இந்த விசாரணைக்கு தடை விதிக்க வேண்டும் என்று கூறியிருந்தார்.

இம்மனு நீதிபதி தனபலான் முன்னிலையில் விசாரணைக்கு வந்தது. மனுவை விசாரித்த நீதிபதி, உமாசங்கர் மீதான ஊழல் தடுப்புப் போலீஸாரின் விசாரணைக்கு இடைக்காலத் தடை விதித்தார். மேலும் ஜூன் 28ம் தேதிக்குள் பதில் மனு தாக்கல் செய்யுமாறு அரசுக்கும் நோட்டீஸ் அனுப்ப உத்தரவிட்டார்.
